加德滿都，賈納克布爾——賈納克布爾高等法院宣判，由法官凱姆·拉傑·巴特（Khemraj Bhatt）與納里什瓦爾·班達里（Narishwar Bhandari）組成的合議庭裁定，大全覺法和 祜如尚士 （拉姆·巴哈杜爾·班堅）、聖亞希師承道師 吉昂·巴哈杜爾·班堅（Gyan Bahadur Bamjan）及 瑪阿特瑪師承道師 迪格·巴哈杜爾·班堅（Dig Bahadur Bamjan）在兒童性侵指控中無罪。案件的完整判決書已於週四（今日）公布，該案於3月20日作出裁決。
此前，吉昂和迪格已被薩爾拉希地方法院宣判無罪，而拉姆·巴哈杜爾則被判有罪並處以刑罰。2081年1月17日（尼泊爾歷），薩爾拉希地方法院曾以兒童性侵罪判處拉姆·巴哈杜爾·班贊10年有期徒刑，並處罰款50萬盧比。
然而，班堅對該判決提起上訴后，賈納克布爾高等法院推翻了原裁定。
賈納克布爾高院表示，在評估現有證據、起訴基礎及證人證言后，認為“證據不足”，未能支持定罪。法院指出，未發現明確證據證明三名被告有罪，故宣布他們無罪。
「我們在當晚就收到了高等法院的正式判決公文。他在隔天一早，被釋放了，」辛杜帕爾喬克監獄代理典獄長尼爾賈拉姆·達奈（Nirjaram Danai）表示。
Kathmandu, Janakpur — The Janakpur High Court, through a joint bench comprising Justices Khemraj Bhatt and Narishwar Bhandari, has acquitted Maha Sambodhi Dharmasangha Guru Ram Bahadur Bamjan, along with Guru marga guru Gyan Bahadur Bamjan and Ma atma guru Dig Bahadur Bamjan, of charges related to child sexual abuse. The full text of the verdict, which was issued on March 20, was released on Thursday (today).
Previously, Gyan Bahadur and Dig Bahadur had been acquitted by the Sarlahi District Court, while Ram Bahadur had been convicted and sentenced. On the 17th of Asar 2081 (Nepali calendar), the Sarlahi District Court had sentenced Ram Bahadur Bamjan to 10 years in prison and imposed a fine of NPR 500,000 for child sexual abuse.
However, after Bamjan appealed the verdict, the Janakpur High Court overturned the earlier decision.
The High Court stated that upon evaluating the available evidence, basis of prosecution, and witness statements, it found the evidence to be insufficient to support a conviction. The court concluded that there was no concrete proof of guilt against the three defendants, and therefore acquitted them.
“We received the official letter of the High Court’s decision that same night. He was released early the next morning,” said Nirjaram Danai, the acting chief of Sindhupalchok Prison.
